I was right! 'Phone before crossing' signs, etc, are ADVISORY only and people using footpath and bridleway crossings come under Highway law. A detailed letter from the DfT states, regarding 'Phone before crossing' signage - 'Unless the signs state that there are consequences for non-compliance, the signs are advisory to PRoW bridleway and footpath users who remain subject to highway law. There is therefore no penalty for non-compliance.' 'Network Rail have, however, indicated that if users were found to be repeatedly ignoring advice from a sign, this could be used as evidence to support the decision to close a crossing in the interests of user safety ( with an immediate temporary closure lasting up to six months ).'
